(8/4/17) — City officials announced today the insurance carrier for the city of Hopkinsville has reached a settlement agreement with former Council Member Ann Cherry, resolving three years of civil litigation. The settlement also includes claims against former Police Chief Guy Howie and Police Lt. Jefferson Alexander.

As part of the agreement, the city of Hopkinsville admitted no wrongdoing and no funds will be paid to Cherry by the city. The entire settlement amount of $150,000 will be paid by One Beacon Insurance Company, the city reported. No tax dollars or general funds will be expended in the settlement.

City Attorney Doug Willen said, “Although we are confident in the city’s position that our officials performed their duties admirably and appropriately and that we would have prevailed in court, we have consented to this agreement at the advice and counsel of our insurance carrier to avoid continued lengthy legal proceedings. Of the three claims asserted by Ms. Cherry, the Federal Court Judge dismissed two claims in their entirety, as having no legal merit. The only remaining claim was set for trial in September, and the expense and disruption of a week-long trial and probable appeal was the primary consideration in allowing the insurance carrier to settle.”

City Administrator Nate Pagan said, “This settlement will allow us to put this issue behind us and spare Ms. Cherry unfavorable media coverage, emotional toil, mental anguish and suffering from a trial. Ultimately, cooperation between all parties has enabled us to reach a resolution that is in the best interest of all involved."
